1. Acceptance of Terms
By accessing or using Bidbayt's mobile application or website (bidbayt.com), you agree to these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Eligibility
Users must be at least 18 years old to register, bid, or list properties on Bidbayt. By using our services, you confirm that you meet this age requirement.
3. Membership & Access
Bidbayt is an exclusive auction platform, and only registered and verified users can view, bid, or interact with listings.
Users agree to provide accurate information for verification purposes.
4. Listing Privacy & Security
Property owners have the right to limit access to their listings to registered and verified users.
Any attempt to access listing details through unauthorized means is a violation of our terms and may result in account suspension.
5. Fair Use & Auction Integrity
Users must not engage in fraudulent bidding or share auction details with non-members. Bidbayt reserves the right to verify accounts, remove suspicious users, and take legal action against fraud.
6. Registration and Account Security
To use certain features, you will need to register and create an account. You are responsible for maintaining the confidentiality of your login details and for any activities that occur under your account.
You agree to provide accurate and complete information when creating your account and to update it as necessary.
7. Property Listings and Bidding
Bidbayt provides a platform for landlords and renters to connect through property rental auctions. However, we do not act as a property broker, agent, or insurer.
Bidbayt does not guarantee the accuracy, completeness, or reliability of listings and is not liable for any errors, omissions, or misleading information.
Bidders agree to comply with all bidding requirements, including making payments and signing leases if they win the bid.
8. Fees and Payments
Using certain features may require fees, which will be communicated in advance. You agree to pay any applicable fees for using Bidbayt.
Payments are processed securely through our payment providers. All payment information remains confidential, and users are responsible for keeping their financial information secure.
9. User Conduct
Users agree to use Bidbayt responsibly and refrain from engaging in fraudulent, misleading, or unlawful activities.
Posting inappropriate or offensive content is strictly prohibited. We reserve the right to remove content and restrict or terminate accounts that violate these Terms.
10. Subject to Landlord Approval
All property offers and rental agreements are subject to final confirmation and approval by the landlord/owner.
11. Payment Terms
Rent amount, number of cheques, security deposit, and agency fees will be as per the landlord's or company's current policy.
Post-dated cheques must be issued according to agreed payment schedule. Late payment may result in applicable penalties or legal action as per the lease agreement.
12. Security Deposit
We reserve the right to suspend or terminate your access to Bidbayt without prior notice if you breach these Terms or engage in any harmful or illegal activity.
13. Agency Fee
A one-time brokerage fee is applicable, usually a percentage of the annual rent, payable upon signing of the tenancy agreement.
14. Ejari Registration
Tenant is responsible for the registration of the lease agreement through the Ejari system, unless otherwise agreed.
15. Utilities and Maintenance
DEWA, gas, internet, and other utility charges are to be paid by the tenant unless explicitly included in the rental contract.
Routine maintenance of the property is the responsibility of the tenant unless specified otherwise in the agreement.
16. Use of Property
The property must be used strictly in accordance with the approved purpose stated in the lease agreement.
- or residential properties, the premises may only be used for personal residential use by the tenant and their immediate family. Subletting, shared accommodation, or commercial use is not permitted without prior written approval from the landlord and relevant authorities.
- For commercial properties, the premises may only be used for the specific business activity approved by the landlord and licensed by the relevant government authority. Any change in business activity or use must be pre-approved in writing by the landlord and comply with local regulations.
Any unauthorized use or modification of the property may result in termination of the lease and legal consequences, including fines or eviction as per UAE law.
17. Handover & Condition
The property will be handed over in clean, functional condition. Tenants are expected to maintain the unit and return it in the same condition (fair wear and tear excepted).
18. Termination & Renewal
Early termination is subject to penalties or forfeiture of part of the rent/security deposit unless mutually agreed.
Lease renewal terms are subject to review and re-approval by the landlord.
19. Limitation of Liability
Bidbayt is not liable for any indirect, incidental, or consequential damages arising from the use of our platform, including lost profits, data, or business interruptions. The app and website are provided "as is," and Bidbayt does not make any warranties or guarantees regarding the platform's performance, reliability, or availability.
20. Modifications to Terms
Bidbayt reserves the right to modify or update these Terms at any time. Users will be notified of significant changes, and continued use of the app or website signifies acceptance of the updated Terms.
21. Termination
We reserve the right to suspend or terminate your access to Bidbayt without prior notice if you breach these Terms or engage in any harmful or illegal activity.
22. Governing Law
All tenancy agreements will be governed by the laws and regulations of the Dubai Land Department and Real Estate Regulatory Agency (RERA).
